Trusted DUI Attorney Serving Victorville, CA Area Drivers

Driving under the influence of drugs or alcohol can have grave consequences. If you’ve been charged with driving under the influence, let the DUI attorneys at Medeiros & Associates Lawyers guide you through the legal process.

The DUI Process

The DUI process starts when a driver is pulled over by an officer on suspicion of drunk driving and is asked to perform field sobriety tests or an official BAC test. The legal limit for blood alcohol content for most adult drivers in California is 0.08%. Commercial drivers are held to a higher standard of 0.04%. Lastly, drivers under the age of 21 must adhere to the limit of 0.01%. If a driver's blood alcohol level is higher than their legal limit, they may be booked and charged with a DUI. The driver will then be held until their bail has been posted or an arraignment hearing takes place.

The arraignment is a driver’s first appearance in court and usually happens a day or two after their arrest. They will be asked to enter a plea of guilty, not guilty, or no contest. The driver may be offered a plea bargain, which allows them to plead guilty and accept the consequences of a lesser charge to avoid trial. If the driver pleads not guilty, court proceedings will move forward, and a verdict will be handed down after a trial.

California DUI Penalties

Penalties for DUI convictions are severe and long-lasting. In California, a first-time offender faces both administrative and criminal penalties, including fines of up to $1,000 and much more in court fees. Jail time and probation may be issued, and the conviction will remain on the driver's record for up to ten years. Drivers may have their license suspended and must reinstate it on a restricted level. It is likely that an ignition interlock device will be installed in their vehicles. Also, first-time DUI offenders are considered high-risk drivers for three years, which means their insurance premiums will increase significantly.
